UPDATED 7th June: Stambridge Mill, Coombes Farm, Core Strategy update



I'm conscious that there hasn't been a post for a while. This Blog is definitely still live. In brief, the challenge to Rochford's Core Strategy by Cogent, the Developers behind the Coombes Farm scheme has now been heard at the High Court in Cardiff. The Judge has "reserved Judgment" which basically means he will consider the evidence presented and make a written Judgment in 6/7 weeks.  If the ruling goes against Rochford the ramifications could be significant, as Cogent will be encouraged to appeal the Council's decision to refuse the second attempt to build on Coombes Farm at a recent Development Committee.

The redevelopment of Stambridge Mill seemed to have stalled until a couple of weeks ago, when an application for the demolition of this historic and famous local structure was put to the Parish Council.  It seems the Diggers will be moving in shortly after all...

  3. The choice of Cardiff is due to it having the least backlog of cases. I'm afraid I don't have any detail on the Agenda or Attendees but as the Hearing is scheduled to last 2 days, starting 31st May, I expect the "guest list" will be varied.

  4. Who is responsible for maintenance of the footpath through Coombes Farm? At present the pathway is very overgrown making it is difficult to use this route. Is the lack of maintenace a ploy to stop locals using this footpath!

  9. My guess is that it the QC has had to consult and given it is the Summer Holidays, etc, there have been delays. The decision, when it arrives, should be posted here http://www.bailii.org/ew/cases/EWHC/Admin/2012/
    You can see that in August, compared to preceding months, there was a sharp drop in Judgments given.
    Not that it should influence this Judgment but, one way or another, it will have a country wide impact on future planning decision. If Rochford's core strategy is not found sound it will open up a nationwide raft of legal challenges. Conversely if Rochford is supported Councils can, at long last, plan with more certainty. Even if Rochford loses it doesn't follow that Coombes Farm will automatically be concreted over. The Green Belt argument still stands but it will leave things far from certain.
